Terms of Service.
The agreement between you and 1Defender Inc. when you use 1Privacy AI.
These Terms govern your use of 1Privacy AI. By creating an account or using the service you agree to them. If you don't agree, please don't use the service.
1. Your account
You sign in to 1Privacy AI with your email address (magic-link sign-in by default; password optional). One account per email. You are responsible for activity on your account. If you think someone else has accessed it, sign out from all devices and contact support@1privacy.ai straight away.
You can close your account at any time from your account settings.
2. Acceptable use
Don't use 1Privacy AI to:
- Break the law.
- Harm other people — including stalking, harassment, doxxing, threats, or generating non-consensual intimate imagery.
- Generate child sexual abuse material (CSAM). Accounts that do are terminated immediately and reported to the appropriate authorities. There is no warning.
- Probe, scan, or otherwise attack the service or anyone else's service.
- Access someone else's account without permission.
- Resell or relicense outputs as if they were a product of your own (you can use outputs for your own work — see § 5 below).
- Bulk-send unsolicited messages.
- Scrape the service in a way that degrades it for other users.
- Commit fraud — including disputing payments for service you actually received.
- Use the service in ways that violate the rules of an upstream AI model provider (we'll generally pass those rules through).
We can suspend or close accounts that don't follow these rules.
3. Subscriptions and wallets
You buy and manage subscriptions and credit top-ups at 1privacy.ai. Our iOS app is a free companion to the web service: it lets you sign in and use the balance you already have, and it does not sell subscriptions or credits in-app.
Subscriptions
We offer monthly subscriptions:
- Plus — $25 / month
- Pro — $50 / month
- Max — $100 / month
Subscriptions renew monthly until you cancel. Cancelling stops future renewals; it does not refund the current month's payment. When you cancel, you keep access until the end of the period you've already paid for.
There are no refunds for partial months.
Wallet credits
Credits are the in-app unit of usage. 1,000 credits = $1.00 USD. You spend credits when you send a message; each AI model has a per-token credit cost, displayed in the app.
You can buy credit top-ups at any time. Top-ups are non-refundable except where required by law. If we accidentally charge you the wrong amount, we'll refund the difference.
If we deduct credits in error (for example, you were charged for a request that the upstream model never completed), tell us and we'll refund the credits.
4. Service quality and availability
We work hard to keep 1Privacy AI available and fast, but we don't guarantee that the service will always be up, error-free, or available in every region. From time to time we may take the service offline for maintenance.
If we know in advance that a planned outage will affect you, we'll try to give you notice in the app.
5. Your content, AI outputs, and intellectual property
You keep all rights to the prompts you write. To the extent permitted by law and by the underlying AI model provider's terms, you also keep all rights to the AI replies you receive — they're yours to use however you want, commercial or not.
We don't claim a licence over your prompts or your AI replies. We don't use them to train AI models.
You're responsible for making sure the prompts you submit and the outputs you use don't infringe anyone else's rights.
6. AI outputs — important
AI models can be wrong, biased, out of date, or confidently make things up. Treat the output as a starting point, not a finished answer. You are responsible for verifying anything you intend to act on — especially anything medical, legal, financial, or safety-critical. 1Privacy AI is a tool; it is not professional advice.
7. Warranty disclaimer
The service is provided "as is" and "as available" without warranty of any kind, express or implied. We disclaim, to the maximum extent permitted by law, all implied warranties including merchantability, fitness for a particular purpose, accuracy, and non-infringement.
8. Limitation of liability
To the maximum extent permitted by law:
- 1Privacy AI's total aggregate liability arising out of or relating to these Terms is capped at the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) $100.
- We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages — including lost profits, lost data, or lost opportunity — even if we've been advised of the possibility.
Nothing in these Terms limits liability that cannot lawfully be limited (for example, gross negligence, fraud, or death/personal injury caused by negligence where applicable law forbids exclusion).
9. Indemnification
You agree to defend and indemnify 1Privacy AI against claims arising from your misuse of the service, your breach of these Terms, your violation of someone else's rights, or content you submitted to the service.
10. Termination
You can close your account at any time. We can suspend or terminate accounts that violate these Terms, that we reasonably believe present a security or fraud risk, or when required by law.
These sections survive termination: payment obligations for usage prior to termination, intellectual-property terms, warranty disclaimer, limitation of liability, indemnification, and governing law.
11. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we'll give you at least 30 days' notice by email and post the updated version. Smaller corrections (typos, link fixes, clarifying language) are updated in place. If you keep using the service after a change takes effect, you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. The exclusive jurisdiction for any dispute is the state or federal courts located in New Castle County, Delaware — except where mandatory consumer-protection law in your country of residence (for example, in the EU/EEA, UK, or Switzerland) gives you the right to bring claims locally.
13. Apple App Store
If you downloaded 1Privacy AI from the Apple App Store, the following also applies to your use of the iOS app, and prevails over any conflicting term above for that app:
- These Terms are between you and 1Defender Inc. only — not Apple. Apple is not responsible for the app or its content.
- Purchases. The iOS app is a free companion to the 1Privacy web service. You buy and manage subscriptions and wallet credits at 1privacy.ai; the app does not sell them.
- Maintenance and support for the app are our responsibility, not Apple's. Apple has no obligation to furnish any support or maintenance.
- Warranty. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund any purchase price paid for the app (the app is free); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app, and any other claims are our responsibility.
- Product claims. We, not Apple, are responsible for addressing any claims relating to the app — including product-liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims under consumer-protection or intellectual-property law.
- Compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist-supporting," and that you are not on any U.S. Government list of prohibited or restricted parties. You will comply with applicable export and trade laws and with Apple's App Store Terms of Service ("Usage Rules").
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to the iOS app and may enforce them against you.
